The website www.exoticacademy.com (the “Website”) is operated and controlled by Exotic Dance Academy. This Agreement sets out the terms and conditions between Exotic Dance Academy (“we”) and you in relation to you visiting the Website.

In visiting this website and/or by registering as a free user or a Premium member, you agree to be bound by the following terms and conditions. Your use of this Website is offered to you on your acceptance of these terms and conditions. We reserve the right to change the terms and conditions under which the Website is offered.

MEMBERSHIP

By using the Website and the Service, you represent and warrant that all registration information you submit is truthful and accurate and that you agree to maintain the accuracy of such information. You further represent and warrant that you are 18 years of age or older and that your use of the Exoticacademy.com shall not violate any applicable law or regulation.  Your Membership is solely for your personal use, and you shall not authorise others to use your account, including your profile or email address, each Exotic Dance Academy account may be used ONLY by the purchaser. Any accounts found to be accessed by multiple users will be shut down and no refund will be provided.

COPYRIGHT AND INTELLECTUAL PROPERTY

Exotic Dance Academy owns and retains all proprietary rights in the Website exoticacademy.com and the Service. The Website contains copyrighted material, trademarks, and other proprietary information of Exotic Dance Academy and its licensors.

You agree not to copy, rewrite, paraphrase, reproduce or distribute in any way any of the material on this website, for commercial or non-commercial use, without prior written approval from Exotic Dance Academy. Recording, transferring performing, displaying in public, broadcasting or making available to the public, selling, renting, sub-licensing or leasing of any part of the Exotic Dance Academy service or the Video lessons and other content is strictly prohibited. 

This includes written content, videos, design layout, strategies, training videos, and any other materials on the Exotic Dance Academy website. If you violate this agreement, we may terminate your membership at any time, and no refund or compensation will be provided. We will also seek injunctive relief and will prosecute to the full extent of the law.

Removing or altering any copyright, trademark, or other intellectual property notices contained on or provided through the Exotic Dance Academy; artificially increasing play count or otherwise manipulating the video lessons by using a script or other automated process; use any automated means (including bots, scrapers, and spiders) to collect information from Exotic Dance Academy;  artificially increasing play count or otherwise manipulating the video lessons by using a script or other automated process is strictly prohibited.

You agree that you will not attempt to start any competitor website, for the entire duration of your membership with us, and for a period of twelve consecutive months thereafter.

NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of the Exotic Dance Academy website, you warrant to Exotic Dance Academy that you will not use the Exotic Dance Academy website for any purpose that is unlawful or prohibited by these terms and conditions. You may not use the Exotic Dance Academy website in any manner which could damage, disable, overburden, or impair the Exotic Dance Academy website or interfere with any other party’s use and enjoyment of the Exotic Dance Academy website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Exotic Dance Academy website.

You may not attempt to monetize any of the content on the Exotic Dance Academy website for commercial gain.

LIABILITY

This content, information, videos, audio and training manuals offered and made available on this website are for informational purposes only. By performing any fitness exercises, you are performing them at your own risk. Pole dancing is not suitable for those who have or are suffering from any physical ailment such as back, neck, muscular injuries or other related medical problems. Pole dancing is also not suitable for pregnant women and those under age 18. Exotic Dance Academy advise to aways consult your physician before beginning any exercise program. Exotic Dance Academy will not be responsible or liable for any injury, loss, death,  damages,  harm any person sustain as a result of the fitness program, online fitness videos, or information shared on the website.

Your use of the Exotic Dance Academy service and all associated software is at your own risk. The content is provided as is, and without warranties of any kind, either expressed or implied. Exotic Dance Academy disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. Exotic Dance Academy does not warrant that the functions or content contained in this site will be uninterrupted or error-free, or that defects will be corrected. Exotic Dance Academy does not warrant or make any representation regarding the use, or the result of, of the content in terms of accuracy, reliability, or otherwise. The content may include technical inaccuracies or typographical errors, and Exotic Dance Academy may make changes or improvements at any time. You assume the entire cost of all necessary servicing, repair or correction in the event you experience any loss or damage arising from your use of the Site. Exotic Dance Academy makes no warranties that your use of the content will not infringe the rights of others and assumes no liability or responsibility for errors or omissions in such content. All content on the Exotic Dance Academy website is provided for information purposes only and should not be seen as advice.

You shall indemnify Exotic Dance Academy on-demand and hold us harmless from and against any and all losses, demands, claims, damages, costs, expenses (including, but not limited to, consequential losses and loss of profit, reasonable legal costs and expenses and VAT thereon if applicable) and liabilities suffered or incurred, directly or indirectly, by Exotic Dance Academy in consequence of any breach, non-performance or non-observance by you of any of your obligations or warranties under this Agreement.

We shall not be liable to you in contract, tort, or otherwise (including liability for negligence) for loss whether direct or indirect of business, revenue or profits, anticipated savings or wasted expenditure, corruption or destruction of data or for any indirect or consequential loss whatever.

We shall not be liable for any loss or damage that you may suffer because of any act of God; power failure; trade or labor dispute; act, failure or omission of any government or authority; obstruction or failure of telecommunication services or networks; or any other act, omission, delay or failure caused by a third party or otherwise outside of our control.

Neither the company, nor the company affiliates, nor any of their suppliers, advertisers or sponsors are or will be liable for any actual, indirect, incidental, consequential, special, punitive or other damages whether under any contract, negligence, strict liability or other theory, arising out of or relating in any way to any of the company sites and materials, or any of the content contained therein, or any product or service used or purchased through the company including, but not limited to, lost revenue or income, loss of capital, pain and suffering, emotional distress, or similar damages, even if the company has been advised of the possibility of such damages. The liability of the company for all damages, losses and causes of action, whether in contract, tort (including, without limitation, negligence) or otherwise, shall not exceed the total amount paid to us by you.

RESULTS DISCLAIMER

We make every effort to ensure that we accurately represent the potential results of Pole Dancing training. Examples made by Exotic Dance Academy are estimates of what you can possibly achieve while exercising with Exotic Dance Academy. There is no guarantee that you will make these levels of progress, and you accept that results differ by individual. The examples are not to be interpreted as any guarantee, promise, representation and/or assurance. 

BILLING

When you purchase a monthly or yearly subscription, the service will be provided to you immediately after purchase.

When you sign up for a Monthly or Yearly membership with us, you set up automatic billing with your card via Stripe (previously i.e. before 25.11.2021 via your PayPal account.)  – secure payment solutions. Your monthly or yearly fee will be debited automatically in line with this. You may cancel at any time by logging in and canceling in the “My Account” dashboard.

For any subscriptions starting before 25.11.2021 – by logging into your PayPal account and managing your pre-approved (automatic) payments.

NOTE: you need to cancel a minimum of 24hrs before the recurring payment is scheduled.

We offer refunds to all customers during their first 7 days of service with us. You will not be able to claim a refund outside of your first 7 days of membership for any reason.

The Website may contain links to other websites (“External Sites”). The External Sites are not under the control of Exotic Dance Academy and Exotic Dance Academy is not responsible for the contents of any External Site, including without limitation any link contained in an External Site, or any changes or updates to an External Site. Exotic Dance Academy provides these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Exotic Dance Academy of the site or any association with its operators.

Informed Consent and Liability Waiver Release for Participation in Exercise Program 

I understand that activities associated with Exotic Dance Academy are physically strenuous and I voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the above mentioned program. I represent and warrant that I have no medical condition that would prevent my participation in the program.  I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Exotic Dance Academy or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

I have read the above waiver and release of liability and fully understand it contents. I voluntarily agree to the terms and conditions stated above.
